What Documents Are Needed to File for Divorce?

When the marriage is over and you’re ready to file for divorce, certain legal documents are required to get the process started. The spouse seeking to end a marriage files a divorce petition with the county or district branch of the state’s superior court family division. In many states, the divorce petition and other required documents for initial filing can be obtained online for free or at the courthouse.

Additional documents may be required later in the divorce process if there are substantial assets to divide or difficult child custody/support issues. For uncontested divorces in which both spouses agree to terms, it may not be necessary to have an attorney…
